Agreement to Terms

By creating an account or using the Solid Ground program, you agree to be bound by these Terms of Use. The Solid Ground program is operated by Resilient Performance Group LLC ("we," "us," or "our," "Company").

The Service

Solid Ground is a digital program consisting of 25 lessons organized in 5 phases, featuring interactive exercises and an AI-synthesized operating manual. The program is accessible at moxieella.com.

Pilot Program Terms

Solid Ground is currently offered at no cost during the pilot phase. The Company reserves the right to transition to a paid model in the future. We will provide reasonable notice before implementing any paid tier.

Your data will be preserved and accessible regardless of whether the program transitions to paid pricing.

Your Account

When you create an account, you agree to:

  • Keep your login credentials secure and confidential
  • Provide accurate and complete information
  • Maintain only one account per person
  • Understand that your account is non-transferable and personal to you

Acceptable Use

You agree not to:

  • Share your login credentials with others
  • Attempt to access other users' accounts or data
  • Scrape, copy, or extract content from the Service
  • Use the Service for any unlawful purpose
  • Attempt to disrupt or interfere with the Service's operation

Intellectual Property

All content, design, and material in the Solid Ground program—including lessons, exercises, frameworks, and other educational materials—are owned by Resilient Performance Group LLC and protected by copyright and other intellectual property laws.

Your Data Is Yours

All data you provide—including assessment responses, lesson responses, check-in data, and your operating manual—is your property. You retain all rights to this data.

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the extent permitted by law, Resilient Performance Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising out of or relating to the Service shall be limited to the amount you have paid to us in the 12 months preceding the claim (or zero during the pilot phase when the Service is free).

Indemnification

You agree to indemnify, defend, and hold harmless Resilient Performance Group LLC and its officers, directors, employees, and agents from any claims, damages, or costs arising from your use of the Service or breach of these Terms.

Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in prohibited conduct.

You may close your account at any time by contacting us or using the account deletion feature.

Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA), rather than in court, except that you may bring an action in small claims court if it qualifies.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or prominent notice on the website. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
